Privacy Policy

This Privacy Policy explains how Machontrol collects and uses personal data when you visit machontrol.com, contact us or do business with us, and what rights you have. It is written for the EU General Data Protection Regulation (GDPR) and Portuguese data protection law.

1. Who we are

The controller of your personal data is A. J. Saraiva Lda (trading as Machontrol), Rua Prof. Rogério Couto 22, 4410-003 Serzedo, Portugal.

2. What data we collect

  • Data you give us. When you use our contact form, email us, call us or message us on WhatsApp: your name, company name, email address, phone number, country and the content of your message. If you become a customer: the business contact and billing details needed to quote, deliver, install and support your machine.
  • Data collected automatically. When you browse our site: technical data such as IP address, browser and device type, and the pages you visit. Analytics and marketing cookies are only set after you accept them in our cookie banner.

We do not ask for special categories of data (such as health data) and we do not knowingly collect data from children.

3. Why we use it and on what legal basis

  • To answer your enquiry and prepare quotations – steps taken at your request before entering into a contract (GDPR Art. 6(1)(b)).
  • To deliver, install and support machines we sell you, and to invoice – performance of a contract (Art. 6(1)(b)) and legal obligations such as accounting and tax law (Art. 6(1)(c)).
  • To keep a record of our business contacts and follow up on enquiries – our legitimate interest in running and developing our business (Art. 6(1)(f)).
  • To send you news about our machines – your consent, or, for existing customers, our legitimate interest in telling you about similar products. Every marketing email has an unsubscribe link and you can object at any time.
  • Website statistics and marketing cookies – your consent (Art. 6(1)(a)), which you can withdraw at any time through the “Manage consent” button on our site.
  • Protecting our forms from spam and abuse – our legitimate interest in keeping the site secure (Art. 6(1)(f)).

4. Who we share it with

We do not sell your data. We share it only with service providers that process it on our behalf and under contract:

  • HubSpot – our customer relationship management (CRM) system, where enquiries and contact details are stored. Our HubSpot account is hosted in HubSpot’s EU data centre.
  • Google – Google Analytics for website statistics (only with your consent) and YouTube for videos embedded on our pages (only loaded with your consent).
  • Cloudflare – Turnstile, which checks that contact form submissions come from a person and not a bot.
  • HostGator – the company that hosts our website.
  • WhatsApp (Meta) – only if you choose to contact us through WhatsApp.
  • Our accountants, carriers and installation partners, and public authorities where the law requires it.

Some of these providers are based in, or may access data from, countries outside the European Economic Area, including the United States. Where that happens, the transfer is covered by the EU–US Data Privacy Framework or by the European Commission’s Standard Contractual Clauses.

5. How long we keep it

  • Enquiries that do not lead to a sale: up to 3 years after our last contact, so we can follow up and keep a history of the conversation.
  • Customer records, contracts and invoices: for as long as the business relationship and machine support last, and at least for the period required by Portuguese accounting and tax law (currently 10 years).
  • Cookies: for the periods listed in our Cookie Policy.

6. Your rights

You have the right to access your data, correct it, have it deleted, restrict or object to its use, receive it in a portable format, and withdraw consent at any time (without affecting processing already done). To exercise any of these rights, email sales@machontrol.com. We reply within one month.

You also have the right to complain to the Portuguese data protection authority, the Comissão Nacional de Proteção de Dados (CNPD) – www.cnpd.pt – or the authority in your own EU country.

7. Cookies

We use strictly necessary cookies to run the site, and statistics and marketing cookies only after you accept them. Details, and how to change your choice, are in our Cookie Policy.

8. Security

Our site uses HTTPS encryption, access to our systems is limited to the people who need it, and our providers are bound by confidentiality and data protection terms.

9. Changes to this policy

We may update this policy when our services or the law change. The date at the top shows the latest version.
